State v. Sum implements a new standard for reviewing whether a law enforcement officer has seized a person that requires courts to consider the longstanding history of racialized policing and police violence in determining whether a person may feel free to terminate an interaction with law enforcement. The Court relies on General Rule 37’s objective observer standard as being defined a person with knowledge of institutional, implicit, and unconscious bias.
